Seat Belt Law

Congressional idiots passed the Safe, Accountable, Flexible, Efficient Transportation Act of 2005 (1) mandating state’s to make it a primary offense for not wearing a seatbelt.  Despite year after year of declining highway deaths due to voluntary compliance to wearing seat belts, now your legislators have given police probable cause to pull you over even when a passenger removes their seat belt without the driver’s permission or awareness.

People have been pulled over because the officer thought the individual wasn’t wearing a seat belt because their clothes matched the color of the seat belt.  Now police are within their authority to pull you over any time and for any reason and falsely claim they thought someone didn’t have a seat belt on, yet not have probable cause or reasonable suspicion.

21-Year-Old Liquor Law

Washington was proud when they passed the National Minimum Drinking Age Act of 1984 (2) that treated 18 & 19-year-olds as second class citizens claiming how many lives were saved by taking away their unalienable right to equal protection of the law.

But Washington couldn’t have done this without the endorsement of your shameless legislators; most of whom couldn’t drink until age 21.

It is hypocritical for Congress to amend the constitution giving 18-year-olds voting rights; yet refuse to treat these adults as equals.  This obvious age discrimination and bigotry by Washington and St. Paul should end. 

.08 BAC

In 1998, The Transportation Equity Act for the 21st Century (TEA-21) (3) was passed by Congress extorting states to adopt a blood alcohol content of .08 BAC. 

Despite the fact that deaths from DUI were already going down in this state without .08 BAC, your lawmakers gave in to extortion.  In fact, most DUI arrests happen at the .10 BAC level anyway.  At .08 BAC most individuals pose little danger to the public safety, but your revenue hungry legislators would rather ruin an individual’s life, good name and stigmatize them forever rather than stand up to Washington.  The lawmakers who betray the public trust are cashing in by selling you out to the paternalistic nanny state Washington bureaucrats for highway revenues, cashing in on court fees, fines and insurance fees etc.  This law was primarily a demagogic power grab trading your freedom for their promise to deliver public safety without delivering substantial results.  No wonder the county courthouse is the biggest business in many parts of the state.
